Competition Law And policy
Competition Law & Policy
The underlying idea of competition is a scenario in which people or organisations compete with one other for something that not everyone can have. Consumers benefit greatly from strong market competition. This is due to two factors: first, competition forces enterprises to be inventive, allowing them to function more effectively; and second, competition provides customers with a wider range of items at cheaper prices.
But there are many prohibited activities are taking place in the market that can adversely affect the healthy competition such as entering into Anti-Competitive Agreements, Abuse of Dominant Position in the market, entering in to merger and acquisitions, where such combination causes or is likely to cause an appreciable adverse effect on competition within the relevant market in India.
To curb such activities Competition Act 2002, play major role, wherein provisions are given which illustrates which activities are banned or which are allowed to sustain a healthy completion and the formulation of the competition regulatory authority in India, the Competition Commission of India (CCI) which was established in 2003 to prevent anti-competitive practices, promote and sustain competition in markets, which protect the interests of consumers and ensure freedom of trade carried on by other participants in markets, and for matters connected with the above or incidental to these.
